Welcome to Maria X. These Terms and Conditions govern the access, navigation, and use of the website, digital platforms, multimedia content, interactive maps, recommendations, experiences, links, services, and any other content related to “María”, “María X” or “María Xochiquetzal” (the “Platform”).

By accessing, browsing, or using the Platform, the user expressly and unconditionally agrees to these Terms and Conditions. If the user does not agree, in whole or in part, with these Terms and Conditions, the user must refrain from using the Platform.

1. Identity of the Responsible Party

“Maria X” is a product, brand, commercial concept, and/or digital service operated by TactIQ Supply, S.A.S. de C.V., located in Mexico City, Mexico.

For purposes of these Terms and Conditions, any reference to “Maria X,” “the Platform,” “we,” “our,” or “TactIQ Supply” shall refer to the owner and operator of the service.

2. Nature of the “Maria” Character

The user acknowledges and agrees that:

“Maria X” is not a real human being.
The image, visual identity, voice, appearance, graphical representation, and related content associated with “Maria” have been created partially or entirely through technological tools, artificial intelligence mechanisms, digital design, visual modeling, and/or marketing and advertising purposes.
Any resemblance to real persons, living or deceased, is purely coincidental.
The Platform uses visual elements, recreations, narratives, tourism references, and multimedia materials for informational, promotional, creative, cultural, and entertainment purposes.

3. Purpose of the Platform

The Platform is intended to:

Share tourism routes and travel suggestions.
Present interactive maps.
Recommend places, restaurants, experiences, and activities.
Consolidate tourism-related information in one place.
Provide access to third-party platforms.
Offer audiovisual, cultural, gastronomic, and recreational content.

4. Maps, Routes, and Recommendations

The user expressly acknowledges and agrees that:

Maps, routes, itineraries, recommendations, schedules, distances, and points of interest published on the Platform are general suggestions and references only.
Routes and recommendations may have been reviewed under reasonable criteria at the time of publication; however, Maria X does not guarantee availability, accessibility, continuity, safety, accuracy, physical conditions, traffic conditions, weather conditions, operational status, or validity of suggested places or routes.

The use of any route or recommendation is carried out solely at the user’s own risk and responsibility.

5. Limitation of Liability

To the maximum extent permitted by applicable law, TactIQ Supply and Maria X shall not be liable for accidents, losses, theft, damages, injuries, physical harm, emotional distress, traffic incidents, falls, material damages, financial losses, cancellations, third-party failures, criminal acts, force majeure events, service failures, establishment closures, schedule modifications, or any direct, indirect, incidental, special, or consequential damages arising from the use of the Platform or from following any routes or recommendations.

The user acknowledges that any physical movement, travel, or activity resulting from information published on the Platform occurs entirely at the user’s own risk.

Users are encouraged to:

6. Use of Third-Party Platforms

The user acknowledges and agrees that:

Such platforms are operated by independent third parties.
Maria X does not control, manage, or supervise the operation of such platforms.
Maria X does not directly operate tours, reservations, payment systems, transportation services, or external services.
Any booking, reservation, payment, cancellation, transaction, or interaction conducted with third-party platforms shall be exclusively between the user and the corresponding third party.

Accordingly, Maria X and TactIQ Supply shall not be liable for non-compliance, cancellations, fraud, itinerary changes, injuries, losses, damages, improper charges, reservation errors, technological failures, service interruptions, or any incident related to third-party platforms or providers.

Users are solely responsible for reviewing the terms, policies, and conditions of such third-party services before using them.

7. Intellectual Property

All elements of the Platform, including but not limited to designs, logos, visual identity, trademarks, texts, narratives, maps, routes, audio, videos, animations, characters, images, interfaces, compilations, and multimedia content are owned by TactIQ Supply or used under applicable licenses, public references, informational purposes, technological mechanisms, or artificial intelligence tools.

8. Use of Images, References, and Third-Party Content

Some images, visual references, names of places, restaurants, monuments, establishments, trademarks, or multimedia materials published on the Platform may have been:

Generated through artificial intelligence.
Obtained from public sources.
Referenced from social media platforms.
Collected from publicly available websites.
Used for illustrative purposes.
Digitally transformed or adapted.
Used as cultural or informational references.

Maria X and TactIQ Supply do not intend to infringe any copyright, intellectual property, trademark, publicity, or related rights.

If any rights holder believes that any content may infringe their rights, they may request a review or removal of such content through formal communication.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

Maria X does not guarantee that:

The Platform will operate uninterrupted or error-free.
The information provided will always be accurate or current.
The content will be free from inaccuracies or omissions.

16. Acceptance

By using the Platform, or any of the services or products related to Maria-X, the user acknowledges having read, understood, and fully accepted these Terms and Conditions.

17. Artificial Intelligence Character and Exclusive Rights

The user acknowledges and agrees that the visual identity, image, voice, gestures, movements, appearance, expressions, audiovisual representation, and digital presence of the character known as “Maria X” or “Maria Xochiquetzal” have been created, generated, designed, or enhanced through artificial intelligence systems, digital modeling technologies, audiovisual processing tools, synthetic media technologies, animation mechanisms, and other creative technological methods.

The character has not been intentionally based on, modeled after, or created from any specific real person. Any resemblance to actual persons, living or deceased, whether in appearance, voice, mannerisms, expressions, or behavior, is purely coincidental and unintentional.

The character “Maria X” including but not limited to her image, visual identity, voice, movements, likeness, digital representations, animations, audiovisual assets, promotional materials, generated content, branding elements, and any derivative works associated with the character, are the exclusive property of TactIQ Supply, S.A.S. de C.V. and/or projects operating under the “Maria X” concept or brand.

Any unauthorized reproduction, imitation, extraction, manipulation, modification, commercial exploitation, redistribution, republication, impersonation, cloning, adaptation, synthetic recreation, or use of the character’s image, voice, likeness, movements, audiovisual identity, or any related elements outside the environments, platforms, products, services, campaigns, or projects officially operated, authorized, or licensed by TactIQ Supply may constitute a violation of applicable copyright laws, intellectual property rights, image rights, trademark rights, unfair competition regulations, and other applicable legal protections under Mexican law and international legislation where applicable.

TactIQ Supply reserves all rights related to the character “María”, “María X”, “María Xochiquetzal” and may pursue any legal or administrative actions deemed appropriate in the event of unauthorized use or infringement.
